These Terms of Service (“Terms”) govern your access to and use of shop-atoleajewelry.store, including its content, features, products, checkout, customer support, and related services collectively, the “Services”.

The Services are offered under the Atolea Jewelry trade name by the legal business identified below and in our Legal Notice.

By accessing the website, creating an account, submitting an order, or otherwise using the Services, you agree to these Terms and to the policies incorporated into them by reference.

If you do not agree to these Terms, you should not use the Services or submit an order.

Nothing in these Terms excludes, restricts, or replaces any mandatory consumer rights available to you under applicable law.

1. Other Policies Included in These Terms

The following policies form part of these Terms:

If there is a conflict between these Terms and a product-specific or promotion-specific condition, the more specific condition will apply to that product or promotion, provided it does not reduce any mandatory consumer right.

2. Eligibility and Authority

By using the Services, you confirm that:

  • You are at least the age of majority in your country or region
  • You have the legal capacity to enter into a binding agreement
  • The information you provide is accurate, current, and complete
  • You are using the Services for lawful personal or authorized business purposes
  • You are not using the Services on behalf of another person without permission

If you are under the age of majority, you may use the Services only with the permission and supervision of a parent or legal guardian.

We make reasonable efforts to present accurate and current information about our products, including:

  • Measurements and sizing
  • Colors and finishes
  • Photographs and videos
  • Care instructions
  • Prices and promotions
  • Availability
  • Warranty eligibility

Small differences may occur between product photographs and the physical product due to lighting, screen settings, photography, manufacturing tolerances, natural materials, or differences between individual pieces.

These reasonable differences do not allow us to supply a materially different product from the one ordered. Products must remain consistent with their description and any mandatory standards that apply.

If a product page contains an obvious typographical, pricing, technical, or descriptive error, we may correct the information. If the error affects an order you already submitted, we will contact you and provide an appropriate option, which may include confirming the corrected information or canceling the affected item for a full refund.

5. Jewelry Materials, Use, and Care

Materials, plating, coatings, stones, pearls, sizing, and care requirements may vary between products. You should review the information provided on the applicable product page before purchasing.

Jewelry may be affected over time by factors including:

  • Impact, scratches, friction, or normal wear
  • Improper storage
  • Harsh chemicals or abrasive cleaning products
  • Cosmetics, perfumes, lotions, or cleaning agents
  • Chlorine, salt water, or prolonged moisture exposure
  • Unauthorized alteration or repair
  • Individual skin chemistry or metal sensitivity

Any product performance, waterproof, tarnish-resistant, hypoallergenic, or durability claim applies only as specifically described on the product page or applicable warranty page.

Individual skin sensitivities vary. Customers with known allergies or sensitivities should review the product materials before purchase and seek appropriate professional guidance where necessary.

6. Prices, Taxes, and Currency

Product prices are displayed in the currency selected for your country, region, or market where supported by the store.

The final price applicable to your order will be displayed during checkout before payment is submitted.

Depending on your destination and applicable law, the price may include or separately display:

  • Value-added tax or sales tax
  • Shipping costs
  • Discounts and promotional adjustments
  • Import duties or customs charges
  • Currency conversion or payment-provider charges

Prices and promotions may change before an order is submitted. Changes will not normally affect an order that has already been accepted, except when there is an obvious pricing or technical error.

Your bank, card provider, PayPal, or other payment provider may apply its own currency conversion rate or international transaction fee. These external charges are controlled by the payment provider and are not retained by us.

7. Promotions, Discount Codes, Bundles, and Free Gifts

Promotions may be subject to additional conditions displayed on the website, product page, cart, advertisement, email, or checkout.

Unless otherwise stated:

  • Promotions apply only during the advertised period
  • Discount codes cannot be exchanged for cash
  • Only one discount code may apply to an order
  • Discounts may not apply to shipping, taxes, gift cards, or excluded products
  • Purchase requirements must be satisfied before the promotion is applied
  • Promotions may be limited by product, customer, country, market, quantity, or availability

For bundles, multi-buy offers, “Buy 2, Get 2 Free” promotions, and gifts with purchase:

  • Eligible products and quantities will be identified in the promotion
  • The discount may be distributed proportionally across the qualifying items
  • Promotional gifts may have no separate cash value
  • Partial returns may cause the remaining order to be repriced
  • The value of an unreturned promotional item may be deducted from a refund where permitted by law

We may cancel or correct a promotion when it contains an obvious technical or publishing error. We will not use false deadlines, false stock information, false customer activity, or misleading promotional conditions.

8. Orders and Contract Formation

Submitting an order is an offer to purchase the products in your cart under these Terms.

After you submit an order, you may receive an automated order acknowledgement. This acknowledgement confirms that we received the order but does not necessarily mean that the order has been accepted.

An order is accepted when we:

  • Send a dispatch or fulfillment confirmation
  • Dispatch the product
  • Otherwise expressly confirm that the order has been accepted

Separate products in the same order may be accepted and dispatched at different times.

We may contact you if additional information is required to process or verify the order.

9. Order Refusal and Cancellation by Us

We may refuse, hold, or cancel an order when reasonably necessary, including when:

  • The product is unavailable
  • The order contains an obvious pricing or technical error
  • Payment cannot be authorized or completed
  • Fraud, unauthorized activity, resale abuse, or payment misuse is reasonably suspected
  • The shipping address is incomplete, invalid, or unsupported
  • The order violates a purchase or promotional limit
  • Fulfilling the order would violate applicable law or platform requirements
  • A product cannot legally or practically be delivered to the destination

If we cancel an order after payment has been collected, we will issue a refund to the original payment method for the canceled amount.

We will not cancel an accepted consumer order for an arbitrary or discriminatory reason.

10. Customer Information and Order Changes

You are responsible for reviewing the following information before submitting an order:

  • Customer name
  • Email address
  • Telephone number
  • Shipping address
  • Billing information
  • Product, size, color, material, and quantity
  • Personalization or customization details

Contact us immediately if you identify an error. We cannot guarantee that an order can be modified after processing or fulfillment has started.

Nothing in this section excludes responsibility when an issue is caused by our error, our service provider, or circumstances for which we remain legally responsible.

11. Payments and Fraud Checks

Payments are processed through Shopify and the payment methods displayed during checkout.

By submitting payment information, you confirm that:

  • You are authorized to use the payment method
  • The billing information is correct
  • The payment provider may authorize and process the transaction
  • Fraud prevention and security checks may be performed

An order may be delayed while a payment or fraud review is completed.

We may request reasonable information to verify the purchaser, payment method, or shipping destination. We will process verification information in accordance with our Privacy Policy.

We will never ask you to provide a complete payment card number or password through ordinary email.

12. Shipping and Delivery

Processing periods, available destinations, shipping methods, delivery estimates, tracking information, and other shipping conditions are described in our Shipping Policy.

Delivery dates are estimates unless we expressly agree to a guaranteed date.

Delivery may be affected by circumstances including:

  • Destination and shipping method
  • Carrier operations
  • Customs inspections
  • Local postal services
  • Public holidays
  • High order volumes
  • Weather events or natural disasters
  • Incorrect or incomplete customer information
  • Events outside our reasonable control

We will provide material delay information when reasonably available and where required by law.

Orders may be fulfilled or shipped by third-party warehouses, logistics providers, manufacturers, or fulfillment partners. The shipping origin may differ from our registered business address.

13. Customs, Import Duties, and Local Charges

International orders may be subject to customs procedures, import duties, taxes, brokerage fees, or local handling charges.

Where these charges are not collected during checkout, they may be assessed by the destination country, carrier, customs authority, or local government.

Responsibility for these charges will be disclosed before purchase where required by applicable law.

We are not responsible for charges imposed independently by a government authority or delivery provider unless applicable law, the checkout, or our published policy states that those charges are included in the purchase price.

14. Delivery, Risk, and Ownership

Risk of loss or damage transfers at the time required by applicable law.

For consumer orders, risk will not transfer merely because a product was handed to a carrier selected by us when applicable law provides that risk transfers only upon delivery to the customer or an authorized recipient.

Ownership of the product transfers after full payment has been received and any other conditions required by applicable law have been satisfied.

15. Customer Cancellations

To request cancellation, contact contact@useatolea.store as soon as possible.

We aim to process orders quickly. Cancellation requests submitted within 12 hours of purchase have the best chance of being completed, but cancellation is not guaranteed after processing or fulfillment has started.

If the order can no longer be canceled, you may be able to return it after delivery under our Return & Refund Policy.

The operational 12-hour cancellation request period does not remove any statutory withdrawal or cancellation right available under applicable consumer law.

16. Returns, Exchanges, and Refunds

Returns, exchanges, damaged products, incorrect products, return shipping costs, promotional returns, and refunds are governed by our Return & Refund Policy.

Eligible return requests under our voluntary return policy may be submitted within 30 calendar days after delivery, subject to the conditions described in that policy.

Customers in certain countries or regions may also have mandatory withdrawal, return, repair, replacement, price reduction, or refund rights.

Nothing in these Terms limits those mandatory rights.

17. Damaged, Defective, or Incorrect Products

Inspect your order after delivery and contact us as soon as reasonably possible if a product is:

  • Damaged
  • Defective
  • Incomplete
  • Incorrect
  • Materially different from its description

We may request your order number, photographs, videos, packaging information, or other reasonable evidence needed to review the issue.

Where a product is confirmed to be damaged, defective, incorrect, or otherwise non-conforming, we will provide an appropriate remedy under our published policies and applicable law.

18. Commercial Warranties

Certain eligible products may include a Lifetime Color Warranty or another commercial warranty when expressly stated on the product page or warranty page.

The applicable warranty information will explain:

  • Eligible products
  • Covered color or manufacturing issues
  • Warranty exclusions
  • Required care
  • Evidence required for a claim
  • Available remedies

Normal scratches, lost products, accidental damage, misuse, improper storage, unauthorized repairs, natural aging, or excluded materials may not be covered unless the applicable warranty states otherwise.

A commercial warranty is additional to, and does not replace, any mandatory legal guarantee or consumer right.

19. Customer Accounts

You may be able to create or use a customer account through Shopify.

You are responsible for:

  • Keeping your login credentials confidential
  • Using a secure password
  • Maintaining accurate account information
  • Informing us of suspected unauthorized account activity

We may suspend an account when reasonably necessary to protect the customer, our business, the Services, or another person.

Account suspension does not remove any obligation to complete or refund an existing valid order in accordance with applicable law.

20. Reviews and Customer Content

You may be able to submit reviews, photographs, videos, comments, testimonials, questions, or other content collectively, “Customer Content”.

You confirm that Customer Content:

  • Is truthful and based on your genuine experience
  • Does not infringe intellectual property, privacy, or publicity rights
  • Does not contain confidential or unlawfully obtained information
  • Does not contain malicious code, spam, threats, harassment, or unlawful material
  • Does not impersonate another person

You retain ownership of your original Customer Content.

By submitting Customer Content, you grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, display, format, and use that content in connection with the website, customer support, product pages, and our marketing, subject to applicable law and your privacy rights.

We may remove Customer Content that violates these Terms, but we will not manipulate reviews in a way that creates a materially misleading impression of customer opinion.

21. Intellectual Property

The website and its content, including its text, logos, graphics, photographs, videos, icons, software, page layouts, branding, and original product content, are owned by us or used under license.

You may use the website only for personal, lawful, and non-commercial shopping purposes.

Unless expressly authorized, you may not:

  • Copy or republish website content
  • Use our trademarks, logos, or branding
  • Use product photographs for another store or advertisement
  • Create derivative commercial materials
  • Sell, license, or distribute website content
  • Remove copyright, trademark, or ownership notices
  • Suggest a partnership, sponsorship, authorization, or affiliation that does not exist

These Terms do not grant ownership of any intellectual property.

22. Third-Party Tools, Platforms, and Links

The Services may rely on or link to third parties, including:

  • Payment providers
  • Shipping carriers
  • Order-tracking platforms
  • Review providers
  • Social media platforms
  • Advertising and analytics providers
  • Customer support tools

Third-party services may be governed by their own terms and privacy policies.

We are not responsible for independent third-party websites that we do not own or control. However, this does not exclude our responsibility for providers acting on our behalf where applicable law makes us responsible.

23. Website Availability and Technical Errors

We make reasonable efforts to maintain a secure and functional website, but we cannot guarantee that access will always be uninterrupted or error-free.

The Services may be temporarily limited due to maintenance, security updates, technical issues, provider outages, or circumstances outside our reasonable control.

We may modify or discontinue a website feature. This will not remove rights or obligations relating to an order already accepted.

24. Disclaimer of Website Warranties

To the extent permitted by law, the website and its general informational features are provided on an “as available” basis.

We do not promise that:

  • The website will be available without interruption
  • Every technical error will be corrected immediately
  • Every device or browser will support every website feature
  • Third-party services will always remain available

This website disclaimer does not apply to mandatory warranties, statutory guarantees, product conformity obligations, or other consumer protections that cannot legally be excluded.

25. Limitation of Liability

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including liability that may apply for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Defective or unsafe products
  • Products that are not as described
  • Intentional misconduct or gross negligence
  • Violation of mandatory consumer rights

To the maximum extent permitted by applicable law, we will not be responsible for indirect or unforeseeable losses that are not a natural consequence of our breach.

We are not responsible for business losses arising from a consumer purchase, including loss of profits, revenue, commercial opportunity, or business data, where the product was purchased mainly for personal use.

Any limitation in this section will be interpreted only to the extent that it is lawful, fair, and enforceable in the customer’s jurisdiction.

26. Events Outside Our Reasonable Control

We are not responsible for a delay or failure caused by an event outside our reasonable control, such as:

  • Natural disasters or extreme weather
  • War, terrorism, civil unrest, or government restrictions
  • Labor disputes or major transportation interruptions
  • Customs or border closures
  • Telecommunications or payment-network outages
  • Cybersecurity incidents not caused by our failure to use reasonable safeguards
  • Major carrier or fulfillment-provider disruptions

We will take reasonable steps to reduce the impact and communicate a material delay when appropriate.

Mandatory rights relating to delayed or undelivered orders remain unaffected.

27. Privacy and Cookies

Our collection and use of personal information is governed by our Privacy Policy.

Our use of cookies, pixels, analytics, and advertising technologies is also described in that policy and through the privacy preference tools available on the website.

28. Suspension and Termination

We may suspend or terminate access to the Services when reasonably necessary because of:

  • A material breach of these Terms
  • Fraudulent or unauthorized activity
  • A threat to website or payment security
  • Abuse of customer support or another person
  • A legal or regulatory requirement

Where appropriate, we may provide notice or an opportunity to correct the issue.

Termination does not affect rights, obligations, payments, refunds, or claims that arose before termination.

29. Changes to These Terms

We may update these Terms to reflect changes in our Services, operations, technologies, or legal obligations.

The updated version will be posted on this page with a revised “Last updated” date.

Changes will generally apply prospectively from the date they are published. The Terms applicable to a purchase are normally those presented when the order was submitted, unless a change is required by law or is expressly agreed with the customer.

We will provide additional notice when required by applicable law.

30. Severability

If a provision of these Terms is found to be unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue to apply.

This does not allow an unfair or unlawful provision to be replaced with another provision that has substantially the same unfair effect.

31. No Waiver

If we do not immediately enforce a provision of these Terms, that does not mean we permanently waive the right to enforce it later.

Any waiver must be specific and will not automatically apply to a different violation or future event.

32. Assignment

You may not transfer your rights or obligations under these Terms without our consent, except where applicable law permits otherwise.

We may transfer our rights and obligations as part of a legitimate sale, merger, restructuring, or transfer of the business, provided that the transfer does not reduce your mandatory consumer rights.

33. Entire Agreement

These Terms, together with the policies and product-specific conditions incorporated by reference, form the agreement between you and us regarding the Services and your purchase.

Nothing in this section excludes a representation, description, promise, or legal obligation that forms part of the consumer contract under applicable law.

34. Governing Law

These Terms are governed by the laws of New Mexico.

However, this choice of law does not deprive a consumer of mandatory protections available under the laws of their country or region of residence.

A consumer may bring a claim before any court or dispute-resolution body that has mandatory jurisdiction under applicable consumer law.

35. Complaints and Disputes

We encourage customers to contact us first so we can attempt to resolve a complaint directly.

To submit a complaint, email contact@useatolea.store and include:

  • Your full name
  • Your order number, when applicable
  • A description of the issue
  • The resolution you are requesting
  • Any relevant photographs, documents, or other evidence

Contacting us first is encouraged but does not remove your right to contact your payment provider, consumer protection authority, data protection authority, court, or other competent dispute-resolution body.

Any alternative dispute-resolution process will apply only where required by law or agreed by both parties.

36. Mandatory Consumer Rights

These Terms provide contractual rules for using the Services and purchasing products.

They do not exclude, restrict, or replace mandatory rights relating to:

  • Product quality and conformity
  • Products that are defective, damaged, unsafe, or incorrectly supplied
  • Products that are not as described
  • Delivery and non-delivery
  • Statutory cancellation or withdrawal
  • Repairs, replacements, price reductions, refunds, or damages
  • Privacy and data protection

If these Terms conflict with a mandatory consumer protection law, the mandatory legal requirement will prevail.
